The USCIS has just announced that the FY 2008 H-1B cap has been hit. In fact, of the available 65,000 spaces for the Fiscal Year to begin October 1, 2007, the USCIS estimates that over 150,000 H-1B cap filings were received on April 2nd. April 2nd , 2007 is now deemed the “final receipt date” for this year’s cap. As the USCIS goes through its data entry processing sorting through this massive number of filings they will subject these petitions to a computer-generated random selection process. Therefore among the cap-subject petitions received on April 2nd and on April 3rd, those that are not randomly selected will be returned to the senders. The USCIS does not presently know how many petitions have been received toward the separate 20,000 H-1B allotment for U.S. master’s graduates due to the receipt of the massive numbers of filings and will on a later date announce the whether the cap has been reached for that segment of filings.
