A short time ago we provided readers with an article on the benefits of premium processing as became available in August of this year for certain EB-3 workers (skilled workers and professionals) and in September of this year for certain EB-1 workers (Outstanding Professors and Researchers), certain EB-2 workers (members of the professions with advanced degrees or exceptional ability not seeking a National Interest Waiver) and "Other" Workers in the EB-3 category (unskilled labor requiring less than two years of training or experience.)
Now the USCIS is continuing to expand this service and on November 13th the USCIS has made available premium processing for EB-1 Aliens with Extraordinary Ability. For workers in categories for which priority dates have retrogressed and it is therefore not possible to complete the I-485 stage immediately, premium processing the I-140 stage may not be worth the $1000. However the article cited above provides several scenarios wherein premium processing the I-140 may be desirable. Also, it is notable that among the categories to which this service has been expanded are categories for which priority dates are still current (all EB-1's, and EB-2's other than Chinese and Indian nationals.) You may keep watch of the most up to date priority dates on each month's Visa Bulletin at www.travel.state.gov. If you believe that you may qualify in one of the exceptional categories that at the present time offers the possibility of an I-140 processed by premium processing AND a current priority date (without need or prior labor certification), namely the EB-1 Alien of Extraordinary Ability or EB-1 Outstanding Researcher or Professor, we offer an on-line case evaluation service related to these categories at NIW/EB-1 Case Reviews link on the left menu. |
