During the past year or so, the Department of Labor has maintained that they would be done sending out 45 day letters by the end of June of 2006. Our office has continued to receive 45 day letters up until now. Therefore, it is apparent that the Department of Labor did not quite make its own deadline.

This morning, several clients contacted us to inform us that they had learned that the Department of Labor was done sending out 45 day letters. This surprised us because as stated above, we continue to receive 45 day letters. Moreover, we still have a few petitions for which we have not received 45 day letters. Instead of relying on rumors, we contacted the Department of Labor. We were informed that while they may be close to finishing their task, they are not yet finished. They also informed us that they would issue a public announcement once they believe they have finished sending out 45 day letters.

Therefore, if you have not received your 45 day letter, it is not time to worry and contact the Department of Labor. Once the Department of Labor has announced that they are done with the 45 day letters, this will be our cue, or your own immigration attorney’s cue, to contact the Department of Labor so that they can track the “missing” labor certification. Whenever the Department of Labor announces that they are done with the 45 day letters, we will promptly post it on our website.
