Department of Labor Announces that the Permanent Labor Certification Backlog Has Been Eliminated

The Department of Labor announced that as of October 1st, 2007, the Labor Certification Backlog was eliminated.   According to the Department of Labor, 99% of the labor certifications have been completed with the remaining 1% awaiting responses from the employers.     Therefore, if you had a non-PERM labor certification pending and your employer or the attorney have not received any correspondence from the Department of Labor, there is probably a problem.   The Department of Labor has issued Backlog FAQs “Round 7” which can be read at www.foreignlaborcert.doleta.gov
 
USCIS Announces Revised Form I-9

USCIS announced that as of November 7, 2007, a revised Employment Eligibility Verification Form (I-9) is available for use.   The major revisions consist of the removal of five documents for proof of both identity and employment eligibility.  The documents so removed consist of the Certificate of U.S. Citizenship, Certificate of Naturalization, the old Alien Registration Receipt Card (Form I-151), the Reentry Permit (Form I-327) and the Refugee Travel Document (Form I-517).   USCIS is encouraging the use of the new form for all hires after November 7, 2007, but it will not penalize employers for usage of the old form until a notice is published in the Federal Register.

Court Extends Order That Blocks Government from Implementing Flawed Social Security "No-Match" Rule

A federal judge extended an order that would temporarily stop the government from implementing a new rule that would cause U.S. citizens and other authorized workers to lose their jobs, and which would illegally use Social Security records as a tool for immigration enforcement.  Full text of the press release can be found here: http://www.nilc.org/immsemplymnt/SSA_Related_Info/ssa005.htm
