Department of Labor Ends Substitution of Foreign Employees on Labor Certifications

Effective July 16, 2007, the current practice of “substitution”, through which an employer can replace one alien applicant with another without the risk of losing his place in the processing line, will be eliminated. This new rule will apply to both pending permanent labor certification as well as approved labor certifications.

April 18th Update on H-1B Cap

On April 13th, USCIS announced that it had used its computer-based random selection process for cap-subject H-1B petitions. It is now almost a full week later and a lot of interested parties are wondering whether the fact that there is no receipt for a given petition means that it was not selected for processing.
